We received this notification on a postcard in the mail yesterday and the time is drawing near to make your claim if you have one. While we are not making any personal or professional remarks regarding the toilet tank, the manufacturer or the Class Action Settlement we do want to make sure that you’re aware this Class Action Settlement exists. It is worth taking 60 seconds of your life and checking the brand and model of your toilet tanks. The faulty issue relays to the porcelain of the tank cracking. Many claims have been made of flooding due to the porcelain of the tank cracking. You can tell if you have a Vortens tank by lifting the lid and looking inside for the manufacturer stamp.
CLASS ACTION SETTLEMENT FOR OWNERS OF VORTENS TANK MODELS 3412 and 3464 MADE IN 2011
You are affected by this class action settlement if you own(ed) a Vortens toilet tank model 3412 or 3464 manufactured between January 1, 2011, and December 31, 2011. A description of how to determine whether you own an affected tank is included on the website www.vortenssettlement.com
WHAT DOES THE SETTLEMENT PROVIDE?
If you are a Settlement Class Member and have not experienced property damage as a result of a cracked tank, if you make a Valid Claim in the Settlement and provide proof of tank ownership and expenses incurred in replacement and/or installation, you will receive reimbursement up to $300.00 per tank. You may make a claim without receipts, but only in conjunction with a declaration sworn under oath upon penalty of perjury, and your recovery is capped at $150.00 per affected tank.
For Settlement Class Members that have experienced property damage as a result of a cracked tank, if you make a Valid Claim in the Settlement and provide proof of unreimbursed out-of-pocket expenses incurred as a result of the cracked tank, you are entitled to reimbursement up to $4,000.00. You may make a claim for reimbursement of proper damage expense without receipts, but only in conjunction with a declaration sworn under oat upon penalty of perjury, and your recovery is capped at $150.00 per affected tank. An unreimbursed deductible is an eligible out-of-pocket expense.
HOW TO GET THE REFUND.
To get your refund, visit the Settlement Website www.VortensSettlement.com and download or complete a Claim Form. You can also obtain a paper Claim Form by contacting the Settlement Administrator.
YOUR OTHER OPTIONS. If you wish to preserve your right to bring a separate lawsuit on these claims, you must exclude yourself from the Settlement Class by July 1, 2019. You can also object to the Settlement, but you must do so by July 15, 2019. COURT HEARTING AND ATTORNEY’S FEES. The Court will hold a Fairness Hearing to consider whether to approve the Settlement, Class Counsel’s request for attorney’s fees and expenses, and $7,500.00 in incentives to the designated individual representatives who pursued the suit. The parties have requested the Fairness Hearing to be set on August 9th, 2019. Please consult the Settlement Website at www.VortesSettlement.com for updated information on the hearing date and time. You or your own lawyer, if you have one, may ask to appear and speak at the hearing at your own cost, but you do not have to.
